Buying a mini excavator in New South Wales (NSW) comes down to three checks: a machine that fits your sites, a trailer you can legally tow and a trained operator. No licence is needed to dig with an excavator in NSW, but SafeWork NSW sets clear rules for quick hitches and moving plant. Lodging a Before You Dig enquiry before excavating is also a legal requirement in NSW.
Choosing a mini excavator for NSW sites
Mini excavators of 1 to 2 tonnes suit most Sydney backyards, side gates and landscaping jobs, while a 5-6 t machine suits house sites, farm work and bigger drainage jobs. Ground in Sydney changes what you need. Much of the city sits on Hawkesbury Sandstone, which a bucket alone often can't remove, so a hydraulic breaker is common on jobs that reach rock. Western Sydney is mostly clay and shale over the sandstone, and many suburban jobs never hit rock at all.

Towing a mini excavator in NSW
Towing a mini excavator in NSW is legal behind a ute only when the loaded trailer stays within every limit that applies. The limit is the lowest of the towbar and coupling rating, the vehicle's towing capacity, the trailer's ATM and the tyre ratings. The vehicle plus loaded trailer must also stay under the vehicle's gross combination mass (GCM), and the towball download counts against the ute's payload.
Work out the loaded weight before you buy. Add the machine's operating weight, buckets, any breaker or auger, fuel and chains, then the trailer's tare. A 1 t machine on a light plant trailer sits well inside a 3,500 kg ute rating. A 1.88 t machine on a braked plant trailer usually lands around 2.6-2.9 t loaded, which still fits if the trailer, towbar, GCM and towball limits allow.
NSW trailer rules for a loaded mini excavator trailer:
- Brakes: none needed up to 750 kg gross trailer mass. From 751 to 2,000 kg, brakes on both wheels of at least one axle. From 2,001 to 4,500 kg, brakes on all wheels, controlled from the driver's seat
- Breakaway: over 2,000 kg, an automatic breakaway system that applies the brakes if the trailer comes off
- Safety chains: one chain under 2,500 kg loaded, two chains crossed over above that
- Speed: 100 km/h maximum when the vehicle and loaded trailer together weigh more than 4.5 t, whatever the posted limit
A Class C car licence covers a tow vehicle up to 4.5 t GVM. A truck or tilt tray above that needs a light rigid or medium rigid licence, so a 5.7 t machine usually goes on a truck or with a float service. Chain the excavator to the trailer's tie-down points with the bucket and blade lowered, and never hook chains onto the tracks.
Do you need a licence to operate an excavator in NSW?
No high risk work licence is needed to operate an excavator for digging in NSW. High risk work licences cover plant such as cranes, forklifts and boom lifts of 11 m or more, not excavators used to dig. The operator must still be trained and competent, and the business running the job should check that competency.
The national training unit is RIIMPO320 (Conduct civil construction excavator operations). Loading and unloading the machine from a trailer is a separate unit, RIIHAN308 (Load and unload plant), and many sites ask for one or both. Anyone working on a construction site also needs a White Card.
A tracked excavator only needs registration if it will be driven on a road. Transport for NSW offers conditional registration for tracked excavators. It needs a Class C licence, an amber rotating beacon, reflectors, mirrors and a horn, with conditions such as daylight use within a defined work area. Most owners skip this and move the machine on a trailer.
SafeWork NSW rules for quick hitches and moving plant
SafeWork NSW does not allow semi-automatic quick hitches. They could not be supplied after 30 April 2014 or used after 31 December 2022, and the same applies to automatic hitches that let the attachment swing if the main lock fails. Buy a fully automatic hitch that locks both pins and holds the attachment if hydraulic pressure is lost, and ask for its compliance with AS 13031:2023.
The Moving plant on construction sites code of practice started on 12 December 2025 and replaced the 2004 code. Work where powered mobile plant moves counts as high risk construction work, so the job needs a Safe Work Method Statement. The code also says a ticket alone doesn't prove someone can run a particular machine.

Asset owners aim to send plans within 2 business days, so lodge early, and lodge again if the plans have expired. Before buying a used machine, run it from cold, check pin and slew ring play, look at the tracks and sprockets, and ask for the service records.
