No, you do not need a licence to dig with a mini excavator in Australia. Excavators are not one of the high risk work licence classes, and the old excavator certificate (class LE) is no longer required under the Work Health and Safety Act 2011. What a work site does need is evidence that the operator is trained and competent. Separate licences can still apply to the jobs around the machine: towing it, lifting suspended loads with it and contracting for excavation work.
Which licences apply to mini excavator work in Australia?
Digging, trenching and spreading soil with a mini excavator need no licence in any state. The licences that do come up belong to the tasks around the digging, and each one has its own trigger.
| Task | What you need | Who issues it |
|---|---|---|
| Digging, trenching, loading | No licence; evidence of competency on work sites | Training provider (RTO) or employer |
| Working on a construction site | White Card (CPCWHS1001 general construction induction) | Registered training organisation |
| Towing or carrying the machine | Car licence (class C) when the ute or truck is 4.5 t GVM or less; light rigid (LR) or higher for a heavier truck | State road authority |
| Lifting a suspended load in WA, machine SWL over 3 t | High risk work licence class CN or C2 | WorkSafe WA |
| Slinging a load for the excavator | Dogging licence (DG) unless the lift is pre-planned and documented | State WHS regulator |
| Contracting for home excavation in NSW over $5,000 | Contractor licence for excavating work | NSW Fair Trading |
| Demolition, asbestos removal, explosives | A licence for that activity | State WHS regulator |
Most mini excavator owners only ever meet the first three rows. A landscaper on a residential site needs a White Card and a tow vehicle they are licensed to drive. The lifting, contracting and demolition rows apply once the work moves beyond digging.
Does Victoria require an excavator licence?
Victoria does not require a licence to operate an excavator either. WorkSafe Victoria issues high risk work licences under the Occupational Health and Safety Regulations 2017, separate from the national WHS laws. Its list has 30 licence classes, and it states plainly that earthmoving equipment such as an excavator can be operated without one. The forklift has its own class, LF, but nothing in the list covers excavators.
How does a business prove an operator is competent?
A business proves an operator is competent with a record, such as a statement of attainment or a logged period of supervised training. The duty sits with the person conducting a business or undertaking (PCBU) that controls the machine. WorkSafe Queensland requires that business to give operators information, training, instruction and supervision before the machine is used.
Removing the licence did not remove the check. It moved the check from the regulator to the business. After an incident, the first thing an inspector asks for is the evidence of competency, so WorkSafe Queensland advises keeping it on file.
The national unit for excavators is RIIMPO320 Conduct civil construction excavator operations, current since 2 September 2026. It replaced RIIMPO320F, so older statements of attainment carry the F code. The national training register notes that no licensing or certification requirement is attached to the unit.
WorkSafe Queensland also accepts certificates issued under the state's repealed 2008 regulation. On-the-job training by a competent person counts too, backed by logbooks or references from a previous employer. An inexperienced operator should work under the direct supervision of a competent person until their skills are proven.
Many civil contractors ask for a verification of competency on their own machine before a new operator starts. A White Card is a different thing: it shows the person completed a general construction safety induction, not that they can run an excavator.
Do you need a licence to dig on your own property?
You do not need a licence or a ticket to dig with a mini excavator on your own property for your own household. Safe Work Australia explains that a person running a household is unlikely to be conducting a business or undertaking, and domestic work around your own home falls in that group. That means the workplace competency duty usually does not reach a homeowner doing their own backyard job.
The picture changes if you pay someone to do the work or run a business from the property. In those cases you can take on the duties of a PCBU.
The machine is the same either way. A 1 tonne Yuchai E12 is 840 mm wide, fits through many side gates and digs to 1,475 mm, deep enough to hit a buried cable.

Which licence do you need to tow or carry a mini excavator?
A car licence (class C) lets you drive a tow vehicle of up to 4.5 tonnes gross vehicle mass (GVM), which covers the utes most people use to move a 1 to 2 tonne excavator. Licence classes are the same in every Australian state and territory.
The machine size decides the vehicle. The 1,880 kg Yuchai U18 goes on a braked plant trailer behind a ute, provided the ute, towbar and trailer ratings allow the combined weight.
The 5,700 kg YC60 is a truck or tag trailer job. A rigid truck over 4.5 t GVM needs a light rigid licence, which runs to 8 t GVM, or a higher class for a bigger truck.
When buying a mini excavator in NSW or any other state, the trailer's brake and breakaway requirements depend on its loaded weight. Add the machine, buckets, fuel and the trailer's own tare before you choose the tow vehicle.
When does lifting with a mini excavator need a licence?
Lifting a load that hangs from chains or slings turns the excavator into a crane, and crane rules then apply. Digging and dumping with the bucket do not count as lifting.
Western Australia has the clearest rule. WorkSafe WA requires a high risk work licence when earthmoving machinery fitted with lifting equipment suspends a load and the machine's safe working load (SWL) is over 3 tonnes. A non-slewing machine needs class CN and a slewing machine, such as an excavator, needs class C2.
An operator can skip the C2 licence by holding a dogging licence and a statement of attainment in SLELIC301 Conduct safe lifting with excavators. The SWL is the most the machine is rated to lift in its strongest position, so check the load chart in the operator's manual.
In Queensland, operating an excavator in crane mode needs no certificate, but the person slinging the load may need a dogging licence. They can work without one only when a licensed dogger, rigger or engineer has set the load weight, lifting gear and procedure in advance and documented it. The load must also stay in the operator's view throughout the lift.
Does a mini excavator business need a contractor licence?
A mini excavator business in NSW needs a contractor licence to do residential excavating work valued at more than $5,000 in labour and materials, including GST. This is a business licence for the work, not a licence to operate the machine. NSW counts excavating as trade work, and unlicensed work can draw a fine of $22,000 for an individual or $110,000 for a company under the Home Building Act 1989. Other states set their own thresholds, so check with the building regulator before quoting home jobs.
What must happen before a mini excavator starts digging?
Before any excavation starts, you must contact Before You Dig Australia for the location of underground cables and pipes. Safe Work Australia also requires the information on underground services to be shared with workers and kept until the job ends.
Depth is the second check. Work in or near a trench 1.5 metres deep is high risk construction work, and a Safe Work Method Statement (SWMS) must be prepared before it begins.
Mini excavators reach that depth quickly. The 1 t E12 stops at 1,475 mm, just short of the line, while the U18 digs to 2,295 mm and the Yuchai YC60 to 3,720 mm. A trench dug by a 2 tonne machine can need a SWMS, even though the operator needs no licence.
Demolition, asbestos removal and blasting each need their own licence. Asbestos that the digging may disturb must be removed by a competent person before work starts.
Before you buy, size the machine to two numbers: the deepest trench you plan to dig and the heaviest load your tow vehicle and licence can handle. The Yuchai compact excavators sold by DJJ Equipment run from 1 tonne machines that travel behind a ute to the 5.7 t YC60 that travels on a truck.
